1. General Information
Software AG South Africa Proprietary Limited (“Software AG SA”), 178 Montecasino Blvd, Monte Circle, Building D, Magaliessig, Sandton, 2191, is the responsible party in accordance with Section 1 of the Protection of Personal Information Act, 2013 (“POPIA”). 2. Personal Information
In terms of POPIA, “personal information” includes information that relates to an identifiable, living, natural person, and where applicable, an identifiable, existing juristic person (such as a company, close corporation, trust and the like). Accordingly, the Privacy Policy will also apply to the personal information of corporate persons to the extent that Software AG SA processes corporate persons’ personal information.

3. Other recipients of personal data
We may transfer or transmit your personal information to  third parties in foreign countries (outside of South Africa), however, we will not transfer or transmit your personal information to a foreign county unless:

• the recipient of your personal information is subject to a law, binding corporate rules or binding agreement that provides for an adequate level of protection as prescribed by POPIA;
• you consent to the transfer;
• the transfer is necessary to fulfill our agreement with you;
• the transfer is necessary for the conclusion or performance of a contract which we concluded in your interests with another person; or
• the transfer is done for your benefit and it is not reasonably practicable to obtain your consent to the transfer and it is not reasonably practical to obtain your consent and, if it were, you would likely have provided your consent.
